BOOKING  CONDITIONS

Please read the following notice as it is your contract with Baymount Outdoor Adventures Inc and clearly lays out what you have agreed with us.

 1)  The Contract

 Baymount Outdoor Adventures Inc. is a registered company with it’s head office in Hillsborough, New Brunswick, Canada.  The contract is between Baymount Outdoor Adventures Inc. (referred to hereafter as Baymount / Company) and the client traveling or intending to travel on a tour operated by Baymount.  The contract is between the Company and the client ("the client" and "you" in these conditions) and we both agree that New Brunswick law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (except as set out below).We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between us must be dealt with by the Courts of New Brunswick

 2)  Reservations & Bookings

To secure a booking, Baymount requires a completed booking form and the necessary deposit or full payment within 90 days of scheduled tour date.  A booking is accepted and becomes definite from the date when Baymount has confirmed acceptance in writing.  It is at this point that the contract between Baymount and the client comes into existence.  The company or their agents reserve the right to decline any booking at their discretion.

Reservations and bookings can be done through your local travel agent, or directly through Baymount Outdoor Adventures travel agent, Earth Trek Unlimited Inc.

 3)  Deposit & Payments

 A non-refundable deposit of $300.00 Cdn. per person is due upon booking of your reservation.  The balance is due 60 days before departure date.

In the case of non payment of the balance by the due date, Baymount may treat the booking as canceled by the client.

 4)  Change in Reservation

 An administrative fee of $50.00 Cdn. will be charged for any changes in the initial reservation

 5)  Factors Outside the Control of Baymount

 Baymount cannot accept any liability or pay any compensation if we are unable to perform our obligations under this contract as a result of “Force Majeure”.  Force Majeure means any event which we or the supplier of the services in question could not, even with all due care and foresight, be avoided.  Such events may include actual or threatened war, riot, civil strife, terrorist activity, border closures, adverse weather, disease, fire and all similar events outside our control.

 6)  Cancellation By The Client

Any cancellation made by the client must be made in writing and the cancellation penalties charged are determined by the date on which Baymount or its agents  receives the cancellation notice.  Cancellation penalties are expressed as a percentage of the total tour price.

60 to 90 days prior to departure    __________   The full deposit

Note: You are strongly encouraged to take out cancellation insurance at the time of booking

 7)  Cancellation Of A Tour By Baymount

 Baymount Outdoor Adventures reserves the right to cancel any trip due to insufficient sign-up or due to unusual or unforseen circumstances beyond the control of Baymount.   Baymount will make every attempt to avoid canceling a tour less than 4 weeks before the scheduled departure date except for instances such as force majeure, unusual or unforseen circumstances that are beyond the control of Baymount.  If we are unable to provide you with an alternative trip that meets your satisfaction, then Baymount will offer a full refund of all moneys paid.

Baymount is not responsible for any additional expenses incurred by participants in preparation for the trip (i.e. non refundable lodging deposits & air tickets, equipment, medical expenses etc.)

 8)  Tour Cost Subject To Change

 Tour costs are subject to change without prior notice, even after you have signed up for the trip.  Published prices are determined up to a year in advance of the tour departure date and because of cost increases by suppliers and / or currency exchange rates, it may be necessary to change tour prices. We reserve the right to adjust tour prices until you have paid the tour price in full. Should increases exceed 10% of the total cost of the tour, participants are free to cancel the tour without penalty.

9)  Insurance

 Baymount requires that each participant take full personal travel insurance that includes coverage for personal accident, medical expenses, air ambulance, loss of effects, and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience to the client.  Clients making their own arrangements should ensure that there are no exclusion clauses limiting protection for the type of activities included in their tour.  Clients may obtain Travel Insurance on their own, through their local travel agent or through Baymount’s agent, Earth Trek Unlimited.

Limited insurance is held by the company.  This booking condition states that the client acknowledges and accepts that he/she is not covered by any Company insurance policy, including all liability insurance for death, injury, damage or loss of any kind.

 10)  Changes to Your Itinerary

 While the Company will do its best to operate all tours as advertised, our tours are arranged many months in advance and because of circumstances beyond Baymount’s control it may become necessary to make alterations to your vacation. Minor changes or adjustments made while the tour is in progress are a common part of travelling in developing countries.  Such changes are made without compensation.     

Occasionally, we have to make a significant change.  If advised of a significant change before departure the client will have the choice of accepting the changed arrangements (at additional cost if applicable), purchasing another available tour from the Company (paying or receiving a refund in respect of any difference in price) or canceling the tour with a full refund of all monies paid to us.

Compensation will not be payable and no liability assumed where we are forced to make a change as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care. Such circumstances are likely to include those listed in clause "Force Majeure

 11)  Travel Documents

 It is the responsibility of each participant to obtain and be in possession of the appropriate travel documents that may include a valid passport, visa and medical certificates. NOTE: Document requirements may vary depending upon your nationality or country of origin.  It is absolutely necessary that your travel agent be aware of the citizenship / nationality of all members of your traveling party.  Baymount cannot accept any responsibility for carriers refusing passage or for failed entry into destinations due to incorrect documentation. No refunds will be given nor will Baymount reimburse any costs associated with documentation difficulties.

We advice participants to contact your local medical health authority regarding vaccinations.

 12)  Airlines

 Baymount tours are advertised and priced as “land only” packages.  Clients are responsible for making flight arrangements either through their own travel agent or by Baymount’s Travel Agent, Earth Trek Unlimited.   Baymount is not liable in respect of either person or property for any loss, damage, injury, accident, delay or irregularity associated with or caused by any airlines that may be used by any client.

 13)  Package Prices

 The tour package price quoted is a “Land Price” only and includes or excludes all of the services  described with each tour package. Prices do not include international airfare to and from the destination country.  For convenience to our customers, land prices are quoted in U.S. dollars

 14)  Unused Services

 No refund is allowed for services offered but not used during the trip.  Tour costs are quoted as a package and credits or refunds are not given for any services not used.

 15)  Acceptance of Risk

 Baymount and the tour operators it works with place extreme importance on the safety and well being of  its clients. Client bookings are accepted however, on the understanding that they appreciate the nature and possible risks inherent in adventure travel and that they undertake the tours at their own volition.  Due to the political and cultural differences, as well as generally more challenging nature, travel throughout Central and South America involves risks other than those we take in our daily lives. 

It is important that clients make themselves aware ( through Government advisories, tourist boards and other sources of information) of the risks involved and are responsible for making their decisions accordingly.

 A Waiver or Acceptance of Risk Form will be required as part of the application process.
